This petition under Article 227 of the Constitution of India was preferred impugning the order dated 1st July, 2015 (in Misc. Civil Appeal No.04/2015 of the Court of Additional District Judge-01, South-West District, Dwarka Courts, New Delhi) allowing the appeal preferred by the respondent Delhi Development Authority (DDA) against the order of the Civil Judge in favour of the petitioner on an application under Order XXXIX Rules 1&2 of the Code of Civil Procedure, 1908. 2.

The petition was entertained and notice thereof issued. 3.

The counsel for the petitioner states that the suit filed by the petitioner from which this petition arises has been decreed and in view thereof this petition has become infructuous.

Dismissed as infructuous.
