Learned APP accepts notice for respondent no. 1.

Respondent nos.2 and 3 Ms. Geeta Srivastav and Mr. Atal Srivastav are present in Court along with their counsel and have been identified by ASI Sanjeev Kumar of police station Gandhi Nagar. They accept notice.

Application is allowed and Crl. M.C. no. 5389/2018 is taken up today. The date fixed in the matter, that is, 16th November, 2018 is cancelled.

CRL.M.C. 5389/2018 Respondent nos.2 and 3 submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion vide a Compromise Deed dated 4th October, 2018. Respondent nos. 2 and 3 say that they have no objection in case FIR No. 223/2018 under Sections 384/34 IPC registered at Police Station Gandhi Nagar and consequent proceedings emanating therefrom are quashed. Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Crl. M.A. no. 34735/2018 is disposed of as infructuous. Dasti.
