The appellant is aggrieved by an interim order dated 09.05.2018, passed by the learned Family Court declining to grant him interim custody of the minor child of the parties, who, by now is 12 years old. 2.

Learned counsel for the appellant states on instructions from the brother of his client, who is present in the Court, that the main petition filed under Section 7 of the Guardians and Wards Act, 1890 for the custody of the child is at an advance stage, as evidence is being led in the matter before the Family Court. He, therefore, requests that the appellant may be granted leave to withdraw the present appeal while reserving his right to approach the Family Court by moving an application for seeking visitation rights in respect of the child.

Leave as prayed for granted. The appeal is dismissed as withdrawn alongwith the pending applications.
