O R D E R
% 11.03.2016 The present bail application has been listed in view of a communication dated 4th March, 2016 received by the Registrar General of this Court from the District & Sessions Judge (East), Karkardooma Courts, Delhi. A perusal of the said communication reveals that the trial in the subject case has proceeded expeditiously and all the witnesses in the case have been examined. However, it is stated that a connected case between the same parties arising out of the same incident, bearing FIR No. 444/2013 is also pending before the concerned District & Sessions Judge (East), Karkardooma Courts, Delhi, the trial of which is ongoing expeditiously. It is further stated that both these cases have to be decided simultaneously and that the trial will be concluded in both the cases as soon as the evidence in the connected matter is concluded.
In view of the foregoing, a request is made that this Court may grant six months' extension to the Trial Court to decide both the cases. The above request has been made in view of the direction of this Court dated 11th August, 2015 in the present bail application whereby the trial Court was requested to
expedite the trial and conclude the same preferably within a period of six months from 19th August, 2015.
There is no gainsaying in the circumstance that six months have elapsed since the said order passed by this Court on 11th August, 2015. In view of the foregoing, whilst granting the extension required, in the facts and circumstances of the case, liberty is granted to the applicant to approach the trial Court afresh with an application seeking enlargement of bail in accordance with law.
It is made clear that the trial in both the cases shall be concluded expeditiously and preferably within a period of six months from 4th March, 2016.
