CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 29.05.2018 This Contempt Petition is filed under section 11 and 12 of the Contempt of Courts Act, 1971 for wilful disobedience of order dated 06.05.2016, 28.11.2016 and 24.04.2017. A perusal of the order dated 06.05.2016 shows that this court had directed the Managing Director or in his absence all the Directors of the respondent company to file their personal affidavits giving details of the company as stated therein. On 28.11.2016 the respondent had sought further time to file the said affidavit. On 24.4.2017 a direction was passed to the Managing Director to be present but none appeared. Costs of Rs.20,000/- was also imposed. Learned counsel appearing for the respondent states that the Managing Director had appeared in court on 22.09.2017. He also submits that the costs have been paid. The only issue survives regarding non compliance of order dated 6.5.2016.

The respondent has already filed his reply. The effect of non compliance of the order dated 6.5.2016 would be seen at the time of

arguments. In my opinion, no grounds are made out to come to a conclusion that there has been wilful disobedience of any orders of this court. Petition is accordingly dismissed. All pending applications, if any, also stand disposed of.
