..... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 06.12.2018 On the previous date, the following order was passed:- "This petition seeks quashing of FIR No. 39/15 dated 20.01.2015 registered under sections 406/420/468/471/506 IPC at Police Station, Baba Haridass Nagar, alleging that the complainant was sought to be sold Gaon Sabha land. In this context, the learned counsel for the State submits that ramification of the offences are not only personal between the parties but far wider and affect the society at large, especially as, the property of the State/Gaon Sabha was sought to be sold by the petitioner. He submits that the matter would require further investigations.

Issue notice. Mr. Sanjay Lao, the learned Additional Standing Counsel for the State accepts notice. A Status Report be filed before the next date. He refers to the earlier order of this Court in Vinod Kumar vs. State of Delhi & Anr. CRL. M.C. 1847/2016 dated 13.05.2016, declining similar reliefs sought by the parties.

List on 06.12.2018."

It is the petitioner's case that he had purchased the said land from the seller and was in possession of the same, without knowledge of the fact that it was government land. He submits that there can be no culpability upon him, therefore, the FIR should be quashed.

The learned counsel for the State opposes the said contention and states that in the present case, government land is sought to be sold by the petitioner and cases of such nature seeking to defraud the State and unsuspecting citizens ought to be dealt with strictly. In view of the above, the Court finds no reason to quash the petition. The petition is without merit. Accordingly, it is dismissed. NAJMI WAZIRI, J DECEMBER 06, 2018 RW
