After arguments, counsel for the appellant has taken instructions from the appellant and it is stated that the appeal can be disposed of as not pressed in case the appellant is granted time to vacate the suit premises on or before 31.10.2020.
Accordingly, while the appeal is disposed of as not pressed, the appellant is granted time to vacate the suit premises on or before 31.10.2020 subject to the appellant filing an affidavit of undertaking in this Court to vacate the suit premises on or before 31.10.2020.
In the meanwhile appellant shall clear all charges towards electricity, water etc payable for the suit premises.

Let the appellant file an affidavit of undertaking in terms of the present order within a period of two weeks, and on the appellant filing the affidavit of undertaking and complying with the terms of the same, the appellant is granted time to vacate the suit premises on or before 31.10.2020. 3.
Since the present appeal is disposed of on the first date without notice to the respondent but in case the respondent has any issue with respect to grant of time, then the respondent can file an application, however, it is noted that if in an appeal of the year 2018 notice is issued and the appeal is admitted, hearing in such an appeal comes ordinarily only after about 10-15 years.

The appeal is accordingly disposed of in terms of the aforesaid order.
