O R D E R

% 22.02.2019 Present suit has been filed for permanent injunction restraining infringement of trade mark, passing off, rendition of accounts, damages etc. Today, learned counsel for defendants, on instructions of defendant No.1, who is personally present in Court, states that the defendants have no objection if the present suit is decreed in accordance with paragraph 37(a) and (b) of the plaint. He further states that the defendants shall withdraw their applications No. 3035920 as well as 3171295 for registration of the device mark/logo within two weeks.

In view of the aforesaid statements, learned counsel for plaintiff, on instructions of Mr. Vishal Vij, authorised representative of the plaintiff, who is personally present in Court, does not wish to press for any other or further reliefs.

The statements/undertakings given by learned counsel for defendants are accepted by this Court and defendants are held bound by the same. In view of the aforesaid statements/undertakings, present suit is decreed. Registry is directed to prepare a decree sheet accordingly. Registry of this Court is also directed to issue to an authorised representative of the plaintiff a certificate authorizing him/her to receive back from the Collector full amount of the Court fee paid by it in the present suit.

With the aforesaid observations, present suit and pending application stand disposed of.
