Mr. Bakshi says that he has instructions to withdraw the appeal. 2.

It is Mr. Bakshi's contention that since the time frame given for concluding the arbitration proceedings has come to an end, nothing survives in the arbitration proceedings.

Mr. Kapoor says that he has no objection to the withdrawal of the appeal.

As prayed, the appeal is dismissed as withdrawn. 5.

Insofar as this Court is concerned, the assertion made with regard to the time frame coming to an end and nothing surviving in the arbitration proceedings is an aspect on which this Court need not comment at this juncture.

Mr. Bakshi says that his right to apply for restoration of the appeal should be kept open.

This will have to be examined in accordance with law as and when that situation arises.
