% 17.12.2018 This is the second petition seeking anticipatory bail filed by the petitioner in case FIR No.
19/2017 under Sections 420/467/468/471/506/120B IPC registered at PS Mehrauli. First anticipatory bail application was dismissed as the petitioner though gave some amount pursuant settlement, however, did not pay the entire amount as the cheques were dishonoured. By this petition, the change of circumstance claimed by the petitioner is that the petitioner has settled with the two victims of this case and since payments after settlement have been made, learned counsel for the petitioner prays that anticipatory bail in the FIR in question be granted. On the last date of hearing in view of the application filed by the proposed intervener that other complaints have also been received this Court had directed the State to file a status report indicating whether in the FIR in question besides the two complainants any other victim has been arrayed or mentioned.
A status report has been handed over as per which in the FIR in question the only victims are namely, Vivek Anand Gupta and Parvinder Singh Yadav. In view of this categorical stand of the State and that the petitioner has settled the matter with the two victims/complainants, namely, Vivek Anand Gupta and Parvinder Sing Yadav, this Court deems it fit to grant anticipatory bail to the petitioner.
It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit.
Needless to state that as and when fresh complaints are received in EOW or any other agency, the State would register FIRs on the said complaints and take action in accordance with law. Petition and application are disposed of.
