Learned APP accepts notice for respondent no. 1. Respondent no.2-Ms. Isha Kapoor is present in Court along with her counsel and accepts notice.
She has been identified by SI Ravi of police station Seemapuri.
Petitioner no.2 is the mother and petitioner no.3 is aunt of petitioner no.1. Respondent no.2 is sister-in-law of petitioner no.1. A quarrel took place on some trivial issue which led to registration of FIR No.247/2016 under Sections 323/341/354/354A/506/34 IPC registered at police station Seemapuri on the complaint of respondent no.2.
Respondent no.2 says that she has settled the matter with petitioners of her own free will and without any undue force, pressure or coercion vide Settlement-cum-Compromise Deed dated 1st September, 2018. She further submits that in view of the settlement, she has no objection in case aforesaid FIR, which is at investigation stage, is quashed against the petitioners.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the FIR pending. Accordingly, aforesaid FIR is quashed.
