$~39 * IN THE HIGH COURT OF DELHI AT NEW DELHI + TR.P.(CRL.) 73/2018, Crl. M.As. 49074-76/2018 (Stay, Exemption & Delay in re-filing) ABHISHEK KUMAR & ORS.
..... Petitioner Through: Mr. Vinod Kumar Khanna, Adv.
versus STATE & ANR.
..... Respondent Through: Mr. G.M. Farooqui, APP for State with Inspector Raj Bala, P.S. South Rohini.
CORAM:
HON'BLE MR. JUSTICE NAJMI WAZIRI
O R D E R
% 07.12.2018 The petitioner seeks transfer of the case because of the observation of the Trial Court during the course of recording of evidence. According to the learned counsel for the petitioner, the Trial Court had put irrelevant queries to the witness. This Court is of the view that relevance of queries by a Court is to be determined at a later stage. It cannot be a reason for seeking transfer. The other reasons contended are equally invalid. The petition is without merits and it is accordingly dismissed. At this stage, the learned counsel for the petitioner seeks to withdraw the petition. It is dismissed as withdrawn.
