This is an application seeking anticipatory bail under Section 438 Cr.P.C. On 14.11.2018, this Court had while directing the petitioner to report before the Investigating Officer for investigation on 15.11.2018 had directed the respondents to file a status report which has since been filed. On placing reliance on the same, Mr.Chadha, learned APP submits that the very day when the petitioner was granted interim protection by this Court, he was found to be indulging in threatening and assaulting witnesses. Consequently, another FIR being FIR No.0525/2018 u/s 452/323/506 IPC has been registered against him at P.S. Burari on 15.11.2018. 2.

On the other hand, learned counsel for the petitioner reiterates

that the petitioner has been falsely implicated in the present case and submits that the present FIR was a counterblast to two FIRs filed by the petitioner's father and brother against the complainant and his associates. He further submits that the petitioner's name was not even mentioned in the FIR and he has been implicated subsequently as a part of the group of persons who had caused of grievous injuries to one Mr.Vikas Tyagi.

I have considered the rival submissions of learned counsel for the parties and perused the record. Keeping in view the nature of allegations against the petitioner and his conduct after being granted interim protection but without commenting on the merits of the case, I am of the view that the petitioner has not made out any ground for granting anticipatory bail to him.
