A Petition under Section 482 Cr.P.C. has been filed on behalf of the Petitioner against the Order dated 04.09.2018 vide which the learned ASJ has upheld the Order of the learned M.M directing framing of Charges. 2.
Learned counsel for Petitioner submits that the trial has now been proceeded and the witnesses are being recorded. The prayer is now limited to the extent that the observations made essentially in the paragraph 49 by learned ASJ while upholding the Order of the learned M.M be clarified to be not a conclusive finding on the merits of the case. 3.
In view of the submissions made, the Petition is disposed of with the observations that any observation made by the learned ASJ in the impugned Order was confined to the aspect of framing of Charge and needless to say that it is not an expression on the merits of the case.
