% 22.03.2018 The petitioners have filed the present writ petition under Article 226 of the Constitution of India. The petitioners seek a declaration that the acquisition proceedings initiated in respect of the land of petitioners comprised in Khasra no.307 measuring 6 bighas 15 biswas, situated in the revenue estate of village Chilla Saroda Bangar, Delhi are deemed to have lapsed in view of Section 24
(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, as neither the actual physical possession of the subject land has been taken nor the compensation has been tendered to the petitioners.
In this case, a notification under Section 4 of the Land Acquisition Act, 1894 was issued on 17.11.1980, a declaration under Section 6 was made on 29.09.1981. Thereafter, an Award bearing no.39/82-83 was rendered on 30.09.1982.
At this stage, counsel for the petitioners wishes to withdraw this petition
and the CM.APPL 13580/2015.
