% 30.08.2017 Petitioners (accused) and private respondent Danish (represented
through his father Shri Haseen Ahmad) and Mohd. Shahid (represented through his brother Mohd. Amir) are stated to have settled their disputes amicably. It is prayed that two cross FIRs may be quashed, details whereof are as under:- FIR No. 737/2016 under Sections 323/324/341/451/506/34 IPC registered at P.S. Jamia Nagar on the complaint of Mohd. Danish (respondent no. 2), complainant in W.P. (Cr!.) No. 2418/2017. FIR No. 691/2016 under Sections 323/308/451/34 IPC registered at P.S. Jamia Nagar on the complaint of Mohd. Shahid (respondent no. 3), complainant in Cr!. M.C. No. 3656/20 16.
Shri Haseen Ahmad and Mohd. Amir are present in Court along with their respective counsels and have been identified by SI Babu La!, PS. Jamia A Nagar. They submit that the matter has been settled, inasmuch as, the settlement has been arrived at without any undue force, pressure or coercion exerted by the petitioners. Memorandums of Understanding dated 1St March, 2017 and 251h September, 2016 respectively have been placed on record and have been admitted as correct. It is submitted that abovementioned FIRs may be quashed, in view of the settlement.
Keeping in view the settlement arrived at between the accused
persons and the complainant/injured, who are neighbours, in the interest of justice both the FIRs, that is, FIR No. 737/2016 under Sections 323/324/341/451/506/34 IPC and FIR No. 691/2016 under Sections 323/308/451/34 IPC, both registered at P.S. Jamia Nagar and the consequent proceedings emanating therefrom are quashed. Faheem Ahmad is stated to be in judicial custody in this case. He be released from jail, if not required in any other case.
Both the petitions are disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J.
