CORAM:

HON'BLE MR. JUSTICE SUNIL GAUR

O R D E R

% 29.10.2018 Impugned order of 28th September, 2018 (Annexure P-1) refuses to grant permission to petitioner to start a new Homeopathic Medical College with hundred seats for the Academic Year 2018-19. Learned counsel for petitioner submits that the impugned order was preceded by an Inspection to which petitioner was a party, but the copy of the said inspection report was not supplied to petitioner. Without getting into the fact as to whether copy of the inspection report was supplied to petitioner or not, it is deemed appropriate to dispose of this petition with direction to respondents to supply to petitioner a copy of inspection report of 8th June, 2018 within a week from today, so that petitioner can file objections thereto, within a week thereafter. Upon receipt of petitioner's objections to the aforesaid W.P.(C) 11690/2018

inspection report, let impugned order of 28th September, 2018 (Annexure P-1) be reconsidered by first respondent within a period of four weeks by giving a speaking response thereto, so that petitioner can avail of the remedies as available in law, if need be. While reconsidering the impugned order (Annexure P-1), a personal hearing be afforded by respondents to petitioner's authorized representative. Needless to say that respondents will not be influenced by the impugned order while reconsidering it.

With aforesaid directions, this petition and the applications are accordingly disposed of.

Copy of this order be given dasti to counsel for the parties. (SUNIL GAUR) JUDGE OCTOBER 29, 2018 s W.P.(C) 11690/2018
