% 20.12.2018 I.A. No.17097/2018 1.

Allowed, subject to just exceptions.

O.M.P.(MISC.)(COMM.) 387/2018 2.

Notice in this petition was issued on 13.12.2018. Despite opportunity, reply has not been filed.

3.

This is a petition filed by the petitioner to seek extension of time. The record shows that this Court appointed an Arbitrator in the matter on 12.7.2017.

4.

The learned Arbitrator held his first hearing on 11.8.2017. Since the statutory period of 12 months was coming to an end, the learned Arbitrator, it appears, on 11.7.2018, requested the parties to give their consent for extension of time.

5.

Counsel for the petitioner says that while consent was granted by the petitioner on 23.7.2018, the respondent failed to do so, despite repeated requests.

O.M.P.(MISC.)(COMM.) No.387/2018 Pg.1 of 2

6.

I am informed by the counsel for the parties that the arguments in the matter have been heard and the matter is reserved for pronouncement of award.

7.

Given the time and money invested by the parties, I am inclined to grant extension of time for concluding the arbitration proceedings, as prayed by the petitioner.

8.

Consequently, time for rendering the award is extended till 28.2.2019. 9.

The captioned petition is disposed of in the aforementioned terms. RAJIV SHAKDHER, J DECEMBER 20, 2018/pmc O.M.P.(MISC.)(COMM.) No.387/2018 Pg.2 of 2
