By filing the instant application under Section 438 Cr.P.C., the petitioner Vishal is seeking anticipatory bail in case FIR No.154/2017 under Section 376/323 IPC, PS Inder Puri, Delhi.

Heard learned counsel for the petitioner as well as learned APP for the State.

The allegations of rape are made against Gaurav - brother of the present petitioner. As per the FIR, the only allegations against the petitioner BAIL APPLN. 1684/2017
Vishal is that when the complainant visited house of Gaurav at E-39, Pusa, his brother Vishal (petitioner herein) and father Ashok Kumar did 'Maar Peet' with her.

Taking into consideration the nature of allegations made against the present petitioner, it is directed that in the event of arrest, the petitioner be released on bail on his furnishing personal bond in the sum of ₹25,000/- with one surety in the like amount to the satisfaction of IO/SHO concerned. However, the petitioner is directed to join the investigation as and when required by the IO/SHO concerned.
