% 26.10.2018 This is a petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No.1202/2015 under Sections 324/341/34 of the Indian Penal Code, 1860 (IPC), registered with PS: Vikas Puri, Delhi and the proceedings emanating therefrom.
Petitioners, as well as respondent No.2, are present in Court and submitted that they have amicably settled the matter, without any pressure, undue force or coercion and the aforesaid FIR as well as the proceedings emanating therefrom may be quashed since they want to live peacefully and blissfully. Learned counsel for the petitioners submitted that the
marriage between petitioner No.1 and respondent No.2 was solemnised on 30.10.2010, according to Sikh rites and ceremonies.
However, due to some differences, FIR No.1202/2015 under Sections 324/341/34 of the IPC, registered with PS: Vikas Puri, Delhi was lodged by respondent No.2 against the petitioners. It is also submitted that respondent No.2 is now living with her husband, petitioner No.1, in a joint family and the misunderstanding, which led to filing of the aforesaid FIR, has been cleared and that the same may be quashed. All the three petitioners as well respondent No.2 have filed their affidavits in this regard.
In view of settlement arrived at between the parties and their intention of living a peaceful and blissful life, this Court is of the view that no fruitful purpose would be served in keeping them entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No.1202/2015 under Sections 324/341/34 of the IPC, registered with PS: Vikas Puri, Delhi and the proceedings emanating therefrom are quashed. Petition is disposed of in above terms. Crl.M.A. 34945/2018 is also disposed of.
