The present bail application has been filed seeking anticipatory bail in FIR No.0088/2018 under Sections 452/506 IPC registered at Police Station Rani Bagh, Delhi.

The present FIR was registered on the allegations that on 02.04.2018 the petitioner entered the house of the complainant and tried to forcibly take away their daughter. The complainant was also manhandled and threats were given to her.

Learned counsel for the petitioner submits that the petitioner is the husband of the complainant and has been a resident of Dubai. It is submitted that the petitioner has been falsely implicated in the present case. On account of the matrimonial discord another FIR No. 44 of 2018 under
Sections 498-A/406/34 IPC P.S. Rani Bagh (North West), Delhi was registered against the petitioner. It is informed that the petitioner has been granted bail in the aforesaid FIR vide order dated 13.12.2019. 4.
Learned counsel for the petitioner submits that the petitioner has joined investigation on 14.02.2020.

Learned APP for the State, duly assisted by learned counsel for the complainant, has opposed the bail application. She however, on instructions, confirms that the petitioner has joined investigation on the aforesaid date. 6.
Learned counsel for the petitioner submits that the aforesaid FIR No. 44/2018 as well as the present FIR are registered in the same police station and that the petitioner has already been directed vide order dated 13.12.2019 (modified on 10.01.2020) passed in FIR No. 44/2018, to make himself available before the I.O. from 16.02.2020 to 26.02.2020 and thereafter from 15.04.2020 to 25.04.2020. The petitioner will make himself available on the aforesaid dates before the IO in the present case as well. He further submits that the petitioner also undertakes to appear before the concerned court as and when directed.

In view of the above facts and circumstances of the case and the fact that the petitioner has joined the investigation, it is directed that in the event of arrest, the petitioner be released on bail, subject to his furnishing personal bonds in the sum of Rs.20,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station and also subject to the following conditions:- (i) The petitioner shall join investigation at the first instance on 20.02.2020 at 4:00 P.M. and thereafter as and when called on the dates mentioned in para 6.
(ii) The petitioner shall not directly or indirectly make any inducement, threat or promises to the complainant or any witness during the trial or tamper with the evidence. (iii) The petitioner shall provide the I.O./SHO Police Station Rani Bagh, Delhi with his mobile number and in the event of change of his residential address, shall inform the same to the concerned I.O./SHO as well as to the concerned Court.

The bail application is disposed of in the above terms. 9.
