Learned APP, on instructions from the Investigating Officer, submitted that, as per the status report, marriage of Farah, sister of the petitioner, has been fixed on 5.11.2018. However, the learned APP submitted that there is possibility that the accused may influence the witnesses or indulge in the same kind of offence or jump the bail, since he is not a resident of Delhi; only the wife of the petitioner, who has two children, is residing in a rental premises in Delhi.
In view of the fact that the marriage of the sister of the petitioner has been verified to be fixed on 5.11.2018, there is no dispute that interim bail in these circumstances can be granted. Accordingly, the petitioner is granted interim bail for a period of four days, i.e., 4.11.2018 to 7.11.2018, subject to the petitioner furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the trial court, with the condition that the petitioner shall not tamper with the evidence and/or threaten the witnesses. It is clarified that no further extension will be granted to the petitioner. The petitioner will surrender before the jail authority on the expiry of his bail period. Bail application is disposed of.
Dasti. A copy of this order be also sent to the Jail Superintendent.
