Learned APP for the State submits that the petitioner has approached this Court directly under Section 438 Cr.P.C. and has not approached the Trial Court in the first instance. 2.

In view of the technical objections raised by the learned APP for the State, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the Trial Court in the first instance. 3.

The petition is, accordingly, dismissed as withdrawn with liberty to the petitioner as prayed for.

It is clarified that this Court has neither considered nor opined on the merits of the matter.
