% 26.10.2018 Due to unauthorized construction, Eviction Notice of 28th September, 2018 (Annexure-1 colly) has been served upon petitioner, which is under challenge in this petition.

Upon notice, counsel for respondent submits that impugned Notice has been issued in compliance of order of Monitoring Committee and has handed over a copy of Communication of 11th June, 2018 by a member of Monitoring Committee, which is taken on record. In view of Supreme Court's order of 15th December, 2017 in W.P.(C) 4677/1985, titled as M.C.Mehta Vs. Union of India & Ors., this petition is not entertained, with liberty to petitioner to approach Supreme Court in pending petition M.C.Mehta (Supra).

With aforesaid observations, this petition and application are disposed of.
