% 26.10.2018 Impugned order of 16th October, 2018 (Annexure P-1) blacklists petitioner from South Delhi Municipal Corporation/MCD Panel. Learned senior counsel for petitioner submits that this order has been passed without affording any personal hearing to petitioner's authorized representative.

Upon notice, learned senior counsel for respondent submits that without prejudice to rights of respondent, a post-decisional hearing would be afforded to petitioner's authorized representative on 30th October, 2018 at 3 P.M. by the Commercial Officer, Advertisement Department of respondent and thereafter, a detailed order would be passed and if a case is made out for recall of impugned order, then impugned order shall be W.P.(C) 11557/2018

withdrawn. Otherwise, the impugned order shall continue to operate. While taking on record the aforesaid undertaking given on behalf of respondent, this petition and the applications are disposed of with direction to petitioner's General Manager/Authorized Representative to appear before respondent's Commercial Officer, Advertisement Department on 30th October, 2018 at 3 P.M.. It is made clear that till the outcome of personal hearing is made known to petitioner, the impugned order shall be kept in abeyance. Needless to say that the parties shall adhere to the aforesaid arrangement made to facilitate the personal hearing. It is clarified that this order has not considered the merits of this case.

This petition and the applications are disposed of in aforesaid terms.
