IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 11639/2018 MAGNUM INTERNATIONAL TRADING COMPANY PVT. LTD.
..... Petitioner Through:

versus VIKAS DHAWAN AND ORS.
..... Respondent Through
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 29.10.2018 CM No.44971/2018 1.
Allowed, subject to all just exceptions.
W.P.(C) 11639/2018 & CM Nos. 44969/2018 & 44970/2018 2.
The petitioner has filed the present petition, inter alia, impugning the proceedings initiated before the National Consumer Disputes Redressal Commission (hereafter 'NCDRC').
It is the petitioner's case that the NCDRC does not have any jurisdiction to entertain the complaint made by the complainants (respondent nos. 1 and 2 herein), as the pecuniary value of the said complaint is below `1 crores.
3.
This Court has no ground to believe that the petitioner's contention would not be considered by the NCDRC. The petitioner states that it would be necessary for the NCDRC to first decide that issue before proceeding
further with the complaint. The said contention is unmerited. It would be open for the NCDRC to decide the complaint finally including the issue of jurisdiction, and the petitioner cannot insist that the complaint be decided in a piecemeal manner.
4.
The petition is unmerited and is, accordingly, dismissed. All pending applications stand disposed of.
