O R D E R

% 17.01.2019 By this petition, the petitioner seeks parole on the ground that he has to file a Special Leave Petition and also challenges the communication dated 25th September, 2018 whereby the application of petitioner for parole was rejected on the ground that the petitioner has not served one year imprisonment excluding the period of remission. A status report and nominal roll have been handed over. As per the status report family of the petitioner comprising of his brother, sister-in-law and their daughter was found residing at H. No. 135 ground floor, West Mukherjee Nagar, Delhi.

As per the nominal roll the petitioner has been in continuous custody from 4th March, 2014 till 28th January, 2018 during the period of trial except for an interim bail for a period of two weeks from 24th March, 2016 which concession he did not misuse. Further after the conviction the petitioner is in continuous custody from 29th January, 2018 and thus almost one year has also passed away from the date of conviction. Considering the facts stated in the status report and the period undergone, this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of `15,000/- with two sureties of the like amount out of which one surety would be a family member of the petitioner subject to the satisfaction of the learned Trial Court.

Petition is disposed of.
