1. Learned counsel appearing for the Respondent No. 1 states that, without prejudice to the contentions of either the Appellant before this Court or Respondent No. 1, he is agreeable to the interim order dated 20th September 2018 passed by the learned Single Judge in CM No. 33866/2018 in W.P. (C) 8810 of 2018, which is under appeal before this Court, being vacated and further that the contentions of both the parties i.e. the Appellant and

Respondent No. 1 be kept open to be urged before the learned Single Judge in the main writ petition and be considered to be disposed of by the learned Single Judge in accordance with law.

2. In that view of the matter, the impugned order dated 20th September 2018 passed by the learned Single Judge in CM No. 33866/2018 in W.P. (C) 8810 of 2018 is hereby set aside.

3. The Court is informed that W.P. (C) 8810 of 2018 is listed next before the learned Single Judge on 21st February 2019.

4. The learned Single Judge is requested to proceed with the final hearing of the writ petition on that date itself. It is made clear that neither party will seek adjournment before the learned Single Judge who will endeavour to finally dispose of the writ petition not later than three months thereafter.
