The petitioner is seeking appointment of an arbitrator under Section 11 of the Arbitration and Conciliation Act.

There is a valid arbitration agreement contained in clause No.38 of the registered lease deed dated 26th March, 2012. The disputes have arisen between the parties, whereupon the petitioner validly invoked the arbitration agreement vide notice dated 12th June, 2015.

The petition is allowed and Mr. Vivek Sood, Senior Advocate, Mobile No.9313781961, is appointed as sole arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The arbitration shall take place under the aegis of Delhi International Arbitration Centre ('DAC').

The DAC shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Act, 2015 before commencement of the arbitration.

5.

Copy of this order be given dasti to counsels for the parties under the signature of the Court Master. A copy of this order be sent to the learned Arbitrator as well as Coordinator, DAC.
