% 08.12.2017 By this petition the petitioner inter alia seeks quashing of FIR No.255/2017 under Section 406/420 IPC registered at PS R.K.Puram and the order dated 9th August, 2017 passed by the learned Metropolitan Magistrate in Complaint Case No.11906/2017 titled as Neeraj Kanagat Vs. D.Pauls Travel & Tours Ltd. wherein directions were issued to register FIR under Section 156(3) Cr.P.C.

Learned proxy counsel for learned Additional Standing Counsel for the State on instructions from the Investigating Officer SI Harbir Singh W.P.(CRL) 2393/2017

states that a cancellation report has been filed pursuant to the investigation. In view of the fact that the cancellation report has been filed, learned counsel for the petitioner seeks leave to withdraw the petition as no cause of action for quashing of the FIR and the order dated 9th August, 2017 survives, with liberty to take remedies in accordance with law, if need arises. Petition as well as the application are dismissed as withdrawn with liberty as prayed for.
