% 23.08.2017 It is submitted that petitioner (husband) and respondent no.2 (wife) have settled their disputes amicably before the Mediation Centre, Saket Court, New Delhi on 21st July, 2017 and are living together, therefore, FIR No. 174/2016 under Sections 498-A/406/34 IPC registered at police station Pul Prahlad Pur may be quashed.
Respondent no.2 is present in Court and has been identified by SI Shyam Lal Dagar of police station Pul Prahlad Pur. She admits that she is living with the petitioner happily, therefore, she does not wish to pursue the FIR any further and the same may be quashed.
Keeping in mind that husband and wife have started living together
after ironing out their difference, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 174/2016 under Sections 498-A/406/34 IPC, which is at the investigation stage, is quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
