O R D E R

% 09.02.2016 I.A. No. 1439/2016 This application has been filed by the parties under Order XXIII Rule 3 CPC. The same has been signed by the parties and their respective counsel and is also supported by the affidavit of Ms.Ella Sen (plaintiff No.1), Dr. Usha Mehta (plaintiff No.2), Ms. Bibha Rani Ray (defendant No.1), Ms. Indrani Lahiri (defendant No.2) and Ms. Sudershani Ray Abott (defendant No.3). A copy of the settlement agreement arrived by the parties on 22.01.2016 has also been placed on record. The parties had appeared before this Court on 25.01.2016 and stated that they had entered into the said settlement. The terms of the settlement appear to be fair, just and reasonable and there is no impediment in accepting the same.

Accordingly, the suit is decreed in terms of the settlement arrived between the parties. The parties shall remain bound by the same. I.A. No. 1440/2016 By this application, the plaintiff seeks return of the original settlement agreement dated 22.01.2016 signed between the parties. Subject to the same being replaced with a certified copy, the same be returned.
