O R D E R

% 29.02.2016 I.A. No. 2803/2016 This application has been moved under Order XXIII Rule 3 CPC to record settlement between the plaintiff and the defendant No.1. So far as the other defendants are concerned, the suit already stands decreed on 18.12.2015.

The application is signed by the parties, their respective counsel and is supported by the affidavit of Mr. Akhilesh Nand, Vice President (Legal) of the plaintiff company and Mr. Sharad Jindal (defendant No.1). The parties have also placed on record the settlement agreement dated 05.02.2016 as Annexure-A to the application, apart from the authorisation in favour of Mr.Akhilesh Nand, Vice President (Legal) of the plaintiff company. The terms of the settlement appear to be fair, just and reasonable and there is no

impediment in accepting the same. Accordingly, the said terms are accepted and shall bind the parties.

The suit stands disposed of in terms of the said settlement. Since the parties have arrived at a settlement at the initial stage, 50% of the Court Fees is directed to be refunded to the plaintiff. VIPIN SANGHI, J FEBRUARY 29, 2016 B.S. Rohella
