CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 28.08.2017 1.
The learned counsel for the petitioner states that after filing of the present petition, the respondent has accepted the petitioner's application for disbursement of compensation under the re-location scheme. 2.
It is seen that there is a dispute as to whether the petitioner or respondent no.4 is entitled to such compensation, as both the parties have applied for the same.
3.
The issue whether the petitioner or respondent no.4 is entitled to compensation involves disputed question of facts and it is not apposite to entertain such controversy in these proceedings. 4.
The petition is, therefore, disposed of with liberty to the petitioner to
file an appropriate proceeding to establish its claim. The learned counsel appearing for respondent states that since two rival claims have been received for compensation, they are not in a position to decide the same and would withhold the payment of compensation till either of the party secures an appropriate order from a Court of competent jurisdiction. 5.
In view of the above, no further orders are required to be passed in this petition. The petition and pending application are disposed of. Order dasti.
