The Appellants were the three defendants in the suit. The respondent is the plaintiff.

Learned counsel for the parties state that the appellants have decided to constitute a moiety and buy over the 1/4th interest of the respondent in the suit property. Learned counsel for the parties state that forming a group as a single entity, appellants have paid the respondent her share in the suit property and thus would pray to the Court that by consent impugned order dated July 02, 2015 may be set aside.

Ordered accordingly.

As desired by the parties we simply record that an application may be filed in the suit based whereon final decree in the suit for partition could be passed which currently is at the stage of a preliminary decree declaring share FAO(OS) 442/2015

of the four parties in the suit property to be 1/4th each. 5.

Appeal is disposed of setting aside the impugned order dated July 02, 2015.

CM No.14667/2015 (Stay) Application is dismissed as infructuous.
