The petitioners have filed the present petition under Section 24 of the Code of Civil Procedure, 1908, inter alia, praying that the suit bearing No. 578621/2016 captioned "Kavita and Ors. v. Seema and Ors." be transferred from the Court of Learned ADJ-03, North-West District Rohini Court to the Court of Learned District Judge, North District, Rohini Court. 2.

It is stated that the said suit was filed seeking declaration, partition and permanent injunction against the respondents, in respect of the subject properties. It was initially instituted before this Court but was transferred to the District Court (North-West), Rohini Court. The learned counsel appearing for the petitioner states that the subject properties, the partition of which are sought, are not within the jurisdiction of the said Court and the same would were fall within the jurisdiction of the North District.

The learned counsel appearing for the respondents does not oppose the present petition.

The petition is, accordingly, allowed and suit bearing No.

578621/2016 captioned "Kavita and Ors. v. Seema and Ors." be transferred from the Court of Learned ADJ-03, North-West District, Rohini Court to the Court of Learned District Judge, North District, Rohini Courts Complex. 5.

The parties are directed to appear before the concerned Court on 19.08.2019.
