% 21.12.2018 By this petition, the petitioner seeks parole on the ground that he is suffering from kidney problem and has to undergo surgery. A medical report has been received which shows that the petitioner is a known case of Hydro-Nephrotic and very poorly functioning Left Kidney with Pelvi Ureteric Junction obstruction with Stricture Urethra with Hyperuricemia. The left sided Nephrectomy was done in March, 2014. The petitioner was taken to RML for Augmentation Urothroplasty and the date of surgery has been fixed for 20th June, 2019. As per the nominal roll the petitioner was granted interim suspension of sentence pending hearing of the appeal as also parole by this Court when he surrendered on 31st August, 2018. Though on both the instances of grant of interim suspension of sentence the petitioner surrendered late by one day W.P.(CRL) 3327/2018
and two days respectively, however, there is no allegation that the petitioner misused the concession of parole granted to him by this Court in the month of August, 2018.
Considering the medical report of the petitioner and that the petitioner needs to undergo surgery, this Court deems it fit to grant parole to the petitioner.
It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹50,000/- with one surety bond of the like amount to the satisfaction of the learned Trial Court.
Petition is disposed of.
