By way of this petition filed under Articles 226 and 227 of the Constitution of India read with Section 482 Cr.P.C., petitioner is seeking quashing of FIR No.361/2015 registered at PS Shahdara under Sections 420/468/471/120-B.

Mr. Rajesh Mahajan, A.S.C. for the State submits that investigation is still in progress and the result from the FSL, Rohini is still awaited. Mr. Rajesh Mahajan further submits that FIR cannot be quashed as the investigation is pending and FSL report is still awaited. 3.

Mr.Sanjeev Sagar, learned counsel for the petitioner submits that the petitioner who is Chief Manager, Union Bank of India may be permitted to W.P.(CRL) 1659/2015

withdraw this petition with liberty to approach the Court subject to the outcome of the investigation. He further submits that this Court has already granted protection to the petitioner vide its order dated 10th August, 2015 by directing that till further orders no coercive steps shall be taken against the petitioner. The petitioner may be given advance notice if investigating agency after completion of investigation wants to take any coercive steps against the petitioner.

Mr. Rajesh Mahajan, A.S.C. for the State submits that at present the investigating agency does not want to take coercive steps against the petitioner and in case any need arises subject to the outcome of the investigation advance notice shall be given to the petitioner by the investigating officer.

The petition is dismissed as withdrawn granting the liberty as prayed. 6.

In case any coercive steps are required to be taken against the petitioner, the IO shall serve 7 days notice on the petitioner and for that purpose the petitioner shall keep the investigating officer informed about his mobile no. and e-mail address.
