% 22.11.2018 Counsel for the respondent submits that the respondent has challenged the Arbitral Award by way of OMP(COMM) 463/2018 which was listed before the Hon'ble Mr.Justice Valmiki J. Mehta today and the enforcement of the Impugned Award has been stayed subject to the respondent depositing 50% of the awarded amount.

Counsel for the petitioner prays for leave to withdraw the present petition with liberty to file afresh subject to further orders being passed in the petition filed by the respondent.

The petition alongwith pending application is dismissed as withdrawn with liberty as prayed for.
