Learned counsel for the petitioner and respondents state that they have settled their differences.
The petitioners have sought quashing of the FIR No.120/2015 (PS Ghazipur) which was instituted for offence under Sections 451/323/427/506/34 of the IPC. Later Section 452 of IPC was added.
The daughter of the petitioner had gone to the house of respondent no.1, who is the brother-in-law of the petitioner no.1. When this fact was learnt by petitioner no.1, he took umbrage at the fact that no such information was given by the respondents and, therefore, the petitioner was entitled to allege that the respondents were involved in kidnapping and abducting his daughter.
However, with the intervention of well-wishers and other family members, the matter has been sorted out and the petitioners, especially petitioner no.1 is not willing to prosecute the case any further. The chargesheet in this case has not yet been filed. Considering the fact that the dispute is inter-personal in nature and all other grievances have been redressed, no useful purpose would be served in allowing this FIR to be investigated any further. If it is allowed to linger any further, it will only be an abuse of the process of law.
Considering the aforementioned facts, FIR No.120/2015 (PS Ghazipur) and other resultant proceedings are quashed.
