Learned counsel for the respondent No.1/Bank and learned counsel for the respondent No. 4 & 5 jointly state that during the pendency of the present proceedings, respondent No. 2/company in which respondent Nos. 3 & 5 are Directors and the respondent No. 3 is a guarantor have directly settled their dispute with the respondent No. 1/Bank and a Certificate dated 07.04.2017 in this regard has been issued by the Bank stating inter alia that the borrower/guarantor do not owe any further amount/liability in respect of the account relating to the respondent No.2. A copy of the Certificate dated 07.04.2017 is handed over by the learned counsel for the respondent No.1, 2 and 4 and a copy furnished to counsel for the petitioner. The same is taken on record.

Learned counsel for the respondent No.1/Bank states that in view of the said Certificate, no claim in respect of subject premises bearing No.E-59 situated in Khasra No.467-468 comprised in Abadi of Jawahar Park, Laxmi Nagar, Delhi remains.

In view of aforesaid submissions, nothing further survives adjudication in the present petition. Accordingly, the same is disposed of along with the pending application.
