O R D E R
% 30.01.2018 In terms of the order dated 08.01.2018, the widow of deceased is present in the Court and she has been identified by her counsel. Proof of identity is taken on record.
Her children from the deceased late Mr. Kayyum, are aged about 9 years, 6 years, 4 years & 3 years. They are under her guardianship and care. So monies would obviously be required for their upbringing. Hence a fair amount should be made available when it is needed. Keeping the monies in FDRs for a few years without use will defeat the purpose of the compensation.
In the circumstances, an amount of Rs. 2 lacs shall be released to the mother/appellant no. 1, while the remaining amount shall be kept in interest bearing FDRs of Rs. 1 lac each to mature every successive year, which shall be credited to the bank account of appellant No.1 along with interest accrued thereon. Should the appellants require more monies in case of exigency, they would have the liberty to approach this Court for
appropriate orders.
The said monies be released to appellant no.1 in her bank account being: State Bank of India-Savings Bank A/c No. 33274129165, BranchKiratpur, Bijnor (Uttar Pradesh), IFSC Code SBIN0010874. The appeal is disposed-off in the above terms. NAJMI WAZIRI, J JANUARY 30, 2018 RW
