% 15.02.2016 CM No.15449/2015 For the reasons stated in the application 110 days' delay in filing the appeal is condoned.
The application is disposed of.
FAO (OS) No.463/2015 1.
Taking cognizance of OMP No.225/2015, a petition filed under Section 34 of the Arbitration and Conciliation Act, 1996, the learned Single Judge has passed the following order:- "Notice to the respondent limited to the amount granted in favour of the respondent in the award, returnable on 17th April, 2015."
FAO(OS) 463/2015
2.
Limited notice issued in the Original Miscellaneous Petition is proof of the fact that certain objections to the award have been rejected. 3.
No reasons have been recorded by the learned Single Judge as to why limited notice was issued and what were the reasons for rejecting part challenge to the award dated December 02, 2014. 4.
We accordingly dispose of the appeal setting aside the impugned order dated March 18, 2015, but making it clear that the learned Single Judge would be entitled to, after stating reasons, maintain that case made out is to issue a limited notice raising challenge to the award dated December 02, 2014.
5.
No costs.
CM No.15448/2015 Dismissed as infructuous.
