% 14.09.2016 The case is taken up today as 13th September, 2016 was declared holiday.

Learned counsel for the petitioner suggested that an independent Sole Arbitrator be appointed by this Court who may decide the disputes between the parties. She does not mind if some retired Judge be appointed. Learned counsel for the respondent submits that as per the arbitration clause this issue needs to be referred to FICCI Arbitral Tribunal. However, he states that he will take the instruction from his client with regard to the suggestion given by the learned counsel for the petitioner. List on 26th September, 2016.
