O R D E R

% 23.02.2016 Learned counsel for the petitioner says that he has heard the statement made by Mr. Sanjay Aggarwal, Managing Director of the respondent company.

Counsel for the petitioner, on instructions of Mr. Sachin Rai, who is present in court, says that the offer to settle the claim raised in the petition for a sum of Rs.2 lakhs is acceptable to the petitioner. Upon receipt of the entire amount, learned counsel for the petitioner undertakes to approach the concerned court for closure of criminal complaint being: CC No.5234/1/2015. I am informed that the next date of hearing in the said criminal complaint is: 31.5.2016. Having regard to the offer made by Mr. Sanjay Aggarwal, Managing Director of the respondent company and its acceptance by the counsel for the petitioner, the petition is disposed of in terms thereof.

Needless to say, the respondent will abide by the terms of settlement. In case there is any breach of the terms of the settlement by the respondent, the petitioner will have liberty to revive the company petition. Further, the petitioner will have the liberty to take recourse to any other remedy that may be available in law.

No further orders are called for.

The petition be consigned to records.

Statement of Mr. Sanjay Aggarwal, son of Mr. Suresh Aggarwal, resident of W-93, Greater Kailash Part-II, New Delhi - 110048 (on S.A.) ** ** ** ** ** ** I say that I am the Managing Director of the respondent company. I say that I have offered to settle the claim made by the petitioner in CP 590/2015 for a total sum of Rs.2 lakhs. In respect of the said amount of Rs.2 lakhs, I will issue a post dated cheque (PDC) dated 15th April, 2016. I will hand over the cheque to the petitioner within three days from today. I undertake to court that if this offer is accepted by the petitioner the said PDC will be honoured on presentation.

In consideration thereof, the petitioner should withdraw the criminal complaint No.5233/1/15, which is pending consideration before the concerned court.
