It is noted that the impugned order which is challenged in this case by way of this appeal has been passed by a Civil Judge. An appeal against the judgment passed by a Civil Judge disposing of a suit will lie to the District Judge and not before this Court. 2.

At the request made on behalf of counsel for the petitioner, this appeal is accordingly treated as a Regular Civil Appeal filed before the District Judge and this appeal is accordingly transferred for decision to the concerned District Judge or any court to which the matter may be assigned by the District Judge. 3.

Let the parties appear before the District and Sessions Judge, Shadhara, Karkardooma Courts, Delhi, on 4th December, 2017 and the District and Sessions Judge will mark the Regular Civil Appeal to a competent court disposal in accordance with law. CMI 7/2017
