% 18.08.2015 CM No. 15267/2015 The exemption is allowed subject to all just exceptions. FAO(OS) 460/2015 and CM No. 15266/2015 In the course of arguments, we had requested the learned counsel for the parties to take instructions as to whether they would agree on an arbitrator so that the arbitration proceedings can go on. The learned counsel for the parties have taken instructions and they agree that the arbitration be conducted at the Delhi International Arbitration Centre in the High Court premises by Mr G.P. Thareja, District Judge. They also agree to the termination of the mandate of the earlier arbitrator who had been appointed by the appellant.

Consequently, this appeal stands disposed of with the direction that the mandate of the earlier arbitrator stands terminated on account of the agreement of the parties and that the arbitration shall now be conducted by the said Mr Thareja in accordance with the rules of the Delhi International Arbitration Centre. The fee shall also

be in accordance with the rules and therefore, the petition pending before the learned Single Judge also stands disposed of.

The appeal stands disposed of.
