Learned counsel for the petitioner submits that though this petition has been filed impugning the order dated 16th May, 2015 whereby his application under Order XII Rule 6 CPC was dismissed by the learned Trial Court but subsequently at the stage of issues learned Trial Court decided the matter in favour of the present petitioner and the respondent has preferred an appeal against that order which is pending before the learned ADJ. 3.

In view of the above, learned counsel for the petitioner seeks permission to withdraw this petition.

The petition is dismissed as withdrawn.
