The petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No.964/2017, under Section 135 of the Electricity Act, 2003 ('the Act'), registered with Police Station Mehrauli, Delhi and the criminal proceedings emanating therefrom.

Learned counsel for the parties submitted that a settlement has been effected between the parties on 10.12.2017 before the Delhi State Legal Services Authority : Special Lok Adalat, in compliance whereof the petitioner has already paid the requisite amount to the respondent No.2. Learned counsel for the parties further submitted that the respondent No.2, after receiving the payment, has also issued a no dues certificate to the petitioner.

Learned counsel for the parties further submitted that in view of the settlement arrived at between the parties and no dues certificate issued by the respondent No.2, the FIR No.964/2017, under Section 135 of the Act as well as the proceedings emanating therefrom may be quashed.

In view of the settlement arrived at between the parties as well as payment made by the petitioner to the respondent No.2 and the fact that no dues certificate has already been issued by the respondent No.2 to the petitioner, this Court is of the view that no fruitful purpose would be served in keeping the parties entangled in the criminal proceedings. Accordingly, in the interest of justice, the FIR No.964/2017, under Section 135 of the Act, registered with Police Station Mehrauli, Delhi and the proceedings emanating therefrom are quashed.

Petition is disposed of in above terms. CRL.M.As.3540735408/2018 are also disposed of. CHANDER SHEKHAR, J OCTOBER 31, 2018/rk
