W.P.(CRL) 1654/2015 This writ application has been filed by the petitioner seeking transfer of case bearing FIR No.1246/2015 (PS Malviya Nagar) instituted for offence under Sections448/380/506 of the IPC to another police station or another agency. The reason for such a prayer is that the petitioner has been made an accused by a lady namely Manju who has lodged FIR No.1667/2014 on 08.12.2014 for the offence under Section 376 of the IPC. The petitioner apprehends that since he has been made an accused by a lady and that case is also being investigated by PS Malviya Nagar PS, his case would not be investigated properly.

During the hearing of this petition, the petitioner appeared in person and

stated that the allegation of rape is absolutely false and he being an old man is not expected to commit such an act. He also raised allegations against the IO/SHO of the Malviya Nagar PS.

Mr. Sanjay Lao, Additional Standing Counsel, on hearing such allegation by the petitioner, requested the Court to adjourn the matter for some time, so that he could consult superior police officers. After consultations, Mr. Lao, informed this Court that the superior police officials, in order to ensure fairness, assured that the case of the petitioner would be transferred to DIU Cell, South, for investigation. In that view of the matter, the grievance of the petitioner does not survive. The writ petition is, therefore, disposed of accordingly. ASHUTOSH KUMAR, J AUGUST 07, 2015 ab
